Lawyer allegedly fired at census worker

A Texas lawyer
was charged with aggravated assault after she allegedly fired five shots from a handgun at a census canvasser.

Carolyn Barnes, 53, of Leander, could face a more serious charge of aggravated assault on a public servant, the Austin American-Statesman reported.

Barnes told Kathleen Gittel to leave after the temporary U.S. Census Bureau employee knocked on her door Saturday, Williamson County Sheriff's Sgt. John Foster said.

"She was apparently not getting off of her property fast enough, and Ms. Barnes decided to shoot five rounds in her direction," Foster said.

None of the shots struck Gittel, Foster said.

Barnes has a history of losing her temper with public employees, the newspaper said. She was charged with assault on a public servant in January after she allegedly hit a sheriff's deputy at the Travis County Courthouse in Austin. In 2000, while fighting a traffic ticket, she wrote the Cedar Park Municipal Court clerk saying she would resist any attempt to arrest her "to the death."

A year later, she said the letter was not a death threat: "I've been practicing law since 1984, and I haven't shot anybody yet, not even come close."

I should note that in Texas, aggravated assault on a public servant is a first degree felony punishable by up to life in prison.

I don't mean to take your thread off topic - but thought that you may be a good person to ask.

Is there a citizenship requirement to be a census worker?

Or are illegal immigrants allowed to do the job also?

If not, what proof of status were you required to provide?

Citizens get preference, but they can hire immigrants authorized to work in the U.S. if there aren't enough citizens. No illegal immigrants. Proof of status requires you to fill out an I-9 like any other job.

Well that's good.

Given the Federal government's unwillingness to enforce Federal Immigration Law it is a surprise thought that they would bother to comply themselves. :laugh:

Honestly? Those people should not be allowed to ever collect any benefits from the government then. She needs a lawyer now? One will not be appointed for her. She needs an ambulance in an emergency? Give us your credit card first. Kids go to school? Good - pay for it.

That woman sounds like a real nut case to me. I invited the census takers in and politely answered all their questions. I'm glad I didn't have to fill out paper work. Arthritis makes that very difficult.

Attorney indicted in Census shooting

WILLIAMSON COUNTY, Texas (KXAN) - A Williamson County grand jury on Thursday indicted attorney Carolyn Barnes, 53, on a charge of aggravated assault with a deadly weapon against a public servant.

It is a first-degree felony punishable by five years to life in prison. District Attorney John Bradley said she could be sentenced to probation if convicted.

Barnes is accused of firing a weapon at a Census worker in May . Kathleen Gittel was not hit in the incident, but Barnes allegedly fired more than one shot at Gittel, telling her to get off her property.

According to Williamson County jail records, Barnes had been booked into the WIlliamson County jail eight times before for charges ranging from contempt of court to making a terroristic threat. In 2002, a Williamson County jury found Barnes guilty of interfering with a routine traffic stop.

Sorry, folks...

I agree that this "person" was way out of line and needs, at the least, therapy.

But, many of those that had face to face encounters with Census Workers and all of those that got the long form questionaire were asked questions that had nothing to do with the Constitutional Mandate of the Census.

And, what with no repercussions for loss or exploitation of your Personally Indentifiable Information...

There is no way I would invite a total stranger in my home and answer questions about income, employment or firearms.

Of course they did acquire GPS cooridnates of every front porch they visited so that if they didn't like the answers back inside the beltway they could more easily send a drone for you when it hits the fan.

I have a feeling that had this nut case wanted to hit the census worker that worker would be dead... So, maybe the actual charge is a bit heavier than truth?

Doesn't assualt require actual "contact"?

Of course, the perp is a nutjob, and ought to go to jail for the full extent of punishment.

But what's the point? Are you trying to justify everything asked on the census? Are you trying to say they have a hazardous jbo and deserve more pay? What exactly are you driving at? Not trying to minimize the wacko's criminal behavior--they ought to have the book thrown at them. But it seems there's an ulterior motve behind your posts on this particular thread.

Paul was a census worker, so he feels the pain of all census workers. If he found an article about someone that was in gifted class in middle school, he's post that as well, since he feels the pain for all gifted students.

Now I've gotten tickled...I looked at the title of the thread again:

Man, that's pretty dangerous. Some of those high-caliber, hollow-point lawyers can cause some real damage.

I just want to know where you buy a gun that fires lawyers. Are they expensive?

Furthermore, why would you waste a perfectly good lawyer on a census worker? (easy, now, just kidding...)

Maybe he's just providing a link to a bizarre human interest story.

When one large group of people (the Census workers) interact with another large group of people (the general public) things like this often happen. There are people who need mental help from all walks of life and across all of the political spectrum.

At least this worker was not hurt, and this woman is off the street. And, hopefully, she will get some mental help as well.

Carolyn Barnes, an attorney, is currently receiving treatment in a state hospital. The ruling that she is not competent to participate in her own defense was based on a May psychiatric examination, said Williamson County District Attorney John Bradley.

Barnes is charged with aggravated assault in the May 2010 attack. The Census worker was not hit in the shooting, but Barnes is accused of firing several shots.

According to Williamson County jail records, Barnes had been booked into the WIlliamson County jail eight times before for charges ranging from contempt of court to making a terroristic threat. In 2002, a Williamson County jury found Barnes guilty of interfering with a routine traffic stop.
