Some apparently believe it is okay to try to hide behind the bill of rights to defend constant slanderous intentional lies but this defense may not work. Not sure if they try to stand on this side of supporting lying morally and/or legally, but in both cases I believe them to be incorrect.
Like the idiots who would laugh about yelling about a fire in movie theater, regardless of people’s lives being interrupted and possibly injured in a panic and dangerous rush to get to safety BECAUSE of someone’s LIE! A lie they wish to claim is their right.
But back to this specific case, we have the precedent of this kind of legal action against LIARS trying to defend their lies by standing on the 1st Amendment succeeding through the LANHAM ACT.

But when they lie to their own viewers and advertisers about the true nature of their business — the very basis of their mission as a news outlet — a media network such as CNN could be found guilty under Lanham Act claims.” -

I just read a CNN article crying over a black school resource officer being fired for using the n-word "Don't call me a n...", after a student called him the n-word. CNN didn't point out that the student who first used the word is black (allowing, if not hoping, the reader would assume the student is white). And, CNN didn't point out that a white officer would be fired for the same thing, but no one would come to that white officer's defense.
That's fake news. That's CNN news every day. A large portion of their home page is devoted to anti-Trump articles, every day. -

The opinions you folks have about CNN can be said(and may have already been said) about any news channel, website, etc., by people of various political stripes.
Y'all ought to see what newspapers said about politicians in the 1800s. -
