Please tell me when a Declaration of War occured. Article I of the Constitution,

My point is that the President and Congress have a responsibilty to follow the Constitution and Declare War and be responsible. Technically we are not at War if we follow the Constitution. </font>[/QUOTE]Considering that a) the followers of a particular ideology and methodology with a political structure but no particular national identity has attacked us repeatedly since the 70's and b) that a purely responsive defense would very likely end in total defeat... who exactly would you have Congress declare war on?
The founders didn't live in a "one punch" world.
Today, if an aggressor can get a first strike with WMD's... it is over.
Our economy went into a tail spin after 9/11... imagine what it would be if coordinated dirty nukes hit 4 or 5 major cities.
We'd be crippled for years.
Historically, criminals have been pursued without a declaration of war (ie the Barbary pirates).
Perhaps a declaration should have been made on Iraq... but Congress did endorse the action so you can hardly say that Bush trampled the Constitution there.

The President's immediate actions prior to the resolution are also Constitutional.
