To continue this rant (my apologies to the OP):
When our system creates wholesale divorces and breaks families apart; when they make drug addicts of out children; when they ignore the problems that they created, I believe they have the duty to clean up their mess.
Breaking up families over a civil misdemeanor
IS a violation of the 8th Amendment which
prohibits cruel and unusual punishment. Apparently my critic on that one never read the Constitution. BTW, it's idiotic as well. With the millions here, there are millions of children that "
could" leave with their families
OR they could stay with a relative, go on welfare and bankrupt the United States. You need a realistic solution.
Getting beyond the immigration religionists, we start to uncover more of the bottom line:
In 1876, the United States Supreme Court gave plenary powers over "
immigration" to Congress. Before that, the states decided who got to come and go within the state. Not only did the Court lack the
constitutional authority to do so, it's been a screwed up mess ever since. But, let's go back before 1876.
In 1868, less than a decade before the above paragraph's role in this, Congress
illegally ratified the 14th Amendment. I noticed,
other than the links I'm going to post, the 14th Amendment states (in part):
"
No State shall make or enforce any law which shall abridge the privileges or immunities of citizens"
Did you see that? The 14th Amendment does not mention making and / or enforcing laws that affect your
unalienable Rights. It goes on to say:
"
nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws"
Can't you see what they did? No person (and an undocumented foreigner is a person) can be denied the
equal protection of the laws (I would argue they already had
unalienable Rights.) I would submit to you if you READ the Preamble to the Constitution, that is more important than arguing that the government does not apply the law the way it was intended. Who cares how an illegally ratified Amendment gets interpreted? Let's look at the Preamble or rather the more important part of it:
"
secure the Blessings of Liberty to ourselves and our Posterity"
We cannot guarantee to every race, religion, color, creed, sexual persuasion, political ideology and social / economic group the blessings that were intended for the citizens of the United States. Trying to reinterpret that illegal Amendment does not change its overall impact on the citizenry. OTHER than my own observations, this is some of why the 14th was illegally ratified:

Repeal the 14th Amendment and replace it with a guarantee that everybody's
unalienable Rights will be absolute, other rights as it applies to foreigners will be clearly spelled out.
It don't matter what side of the political fence I'm sitting on, one of your major problems is the 14th Amendment. It took away our
unalienable Rights and replaced them with privileges and immunities; it guaranteed people (whether documented or not) equal status with the citizenry. Repealing it has to be a major focus or you are kidding yourself.
