The individual mandate has been ruled unconstitutional under the commerce clause but will stand under taxing power.

Not really this ruling came out of left field. The mandate did not get upheld based on the original argument the commerce clause. It was ruled that we cannot be mandated to purchase anything based on the commerce clause.
What no one saw coming was it was upheld because the SC said it is not their place to stop the government from making a tax on this issue. -
States do not have to expand their Medicare coverage in this ruling. In other words states can choose not to do this.
-
It is now clear that Obama lied. It was argued by his lawyers that the mandate is a tax. The SC now says the mandate is upheld as a tax. If you do not buy insurance you will be taxed.
It is a tax bottom line. -

I am somewhat surprised by this ruling. I would have been more likely to strike it down, but I am willing to accept the ruling. Hopefully we can now move forward and proceed to a single-payer, universal healthcare system. While I've never been a big fan of the Affordable Care Act, I'm grateful the positive benefits of this law will continue to improve the lives of Americans.

If Obama gets away with the HHS mandate, what do you think is next? So much for Religious Freedom in the nation. -
As I said yesterday on another thread:
Turns out, the Chief Justice IS a turncoat. :tear:
And I was wrong on the numbers, 5-4, not 6-3. But as I have said all along in the Politics Forum, the SC is in cahoots with the obama administration and their recent ruling about Arizona and now this just serves to further prove that. Sad day for the Constitution. Sad day for Patriots. Sad day for a lot of people who will find they will never end up with what obama and the dems said they would have and the entire healthcare system will be crushed to where only the young, healthy, rich people will be able to afford healthcare. But we working people will be paying for it even if we don't have insurance......
Since the SC ruling says states don't have to set up exchanges but can't be penalized on funds rec'd from the feds for medicaid, and there are at least 26 states who have filed suit, and others who refuse (like NJ) to set up these exchanges, we see our nation further divided once again - states vs states.
What I am saying is, states that set up the exchanges will see an increase in residents as people move there to get in on the healthcare for low and middle income families. If you move to a state with an exchange, even if you have no job, you will get the free healthcare. Watch the population shift. Americans are not dumb. Loss of jobs, loss of insurance, loss of homes, high unemployment, expiring UE benefits, tend to make people more mobile, to go where they can get what they can.
We can also expect, as pointed out above, more jobs to move off shore as employers will not be able to keep up with these "taxes"/mandates even with paying the fines. Or, since it affects (for the most part) employers with 50+ employees (the way I understand it), expect companies to downsize to escape the mandates (those who haven't already gotten obamacare waivers from HHS), and/or close up - creating more unemployment and more and more poor in the USA, more uninsured.
And expect more people to work "under the table" so they don't have to pay taxes or the "new" taxes. Yes, we can say the TAX word now that the SC has made it legal to say so. It is a NEW TAX. Brought to you by obama, Pelosi, Reid, and the Democratic Party, delivered on Christmas Eve to the American people with an over-sized stage prop gavel carried proudly and defiantly up the steps of Congress by Speaker Pelosi. -
I'm reading the syllabus of the opinion and one of the things brought up is the penalty can be considered a tax for some purposes but not others. The issue of whether it is a tax in the common usage of that term is separate from whether it is a tax for constitutional purposes.

In fact I only know of one and maybe two true conservatives in the government and that one is Ron Paul (I am not pushing Ron Paul). Almost without exception every person today who claims to be a conservative is either a moderate or liberal.
The claimed conservatives are looking at what they call liberals and moderates and because they think they (self proclaimed conservatives) hold to a more narrow line that makes them conservatives when in fact they are just another form of liberal or in some few cases moderate.
Although we claim this is all political it is actually spiritual. Until the claimed conservatives admit that they have left their Lord's teachings and fall on their face in repentance so as to be healed this nation will continue on the track it is headed.
Let me close with this. Mitt Romney will now double his efforts on this claiming he will get this appealed. READ MY LIPS! IT WILL NEVER HAPPEN unless the church returns to its roots in the bible. We are rejecting the way of God and God is returning the favor. What lies ahead is the fall of this nation becoming like a third world nation and a military form of government. We are going to see all the deaths of those men and women who have fought for our freedoms be trampled on. We are no longer a government of the people, by the people, for the people and we are seeing it take place before our eyes. -
Not sure what those benefits would be.
So does your employer provide your health insurance?
If not will you be able to afford the cost of buying your own insurance or pay the tax if you can not afford insurance?
This is just a tax on the poor.
Can't afford health insurance?
Fine then just pay the tax. -
-
And people who have no money still won't have the money to buy insurance even if it is subsidized.
That is the whole point of the tax/fine for not having insurance. To make people pay for insurance even if they can't afford it. -
This whole thing has been a charade from the beginning. The republicans will not repeal this. They will make a half hearted attempt to save face and lose in the attempt and then offer the working public some sort of tax break or something similar for taking the insurance so as to beat the tax in part.

You do not like the law just upheld.
What is your suggestion to fix the health insurance mess? -
They have invented a new kind of tax
A new tax that will be collected and retained by the multinational corporations. You Republicans should love it.
Next will be a requirement for people without a job related pension to pay into an IRA. Government and private pensions can then be eliminated. You Republicans will love it. -
> But as I have said all along in the Politics Forum, the SC is in cahoots with the obama administration
You Neocons don't get it! The SC AND Obama AND the Republicans are in cahoots with the multinational corporations.
